GENERAL TERMS AND CONDITIONS FOR USING THE DINNER IN THE SKY® ONLINE ORDERING SYSTEM

1. Visitors and users of the Internet-based online ordering system “Dinner in the Sky®” (hereinafter referred to as the “Online Shop”) agree to the following terms and conditions (hereinafter referred to as the “Terms”):

3. Skyworld International does not organise any events. The Onlline ordering system sells tickets on behalf of, in the name and at the expense of the Organiser Skyworld Entertainment OÜ (hereinafter referred to as the Organiser), whose registration number is: 12960432, whose registered office is located at Kopli 69C, Tallinn, Estonia.Skyworld International has no right to set or change ticket prices or conditions of sale, nor to determine the number of seats at any event; Skyworld International will not buy back or replace tickets or refund destroyed, lost, stolen, damaged, etc. tickets. Skyworld International will not be liable for any damages in connection with the event, nor for the value of any items lost under any circumstances. The rights and obligations arising from the tickets are determined and notified by the organiser of the respective event and Skyworld International shall in no circumstances be liable for the content, modification and enforcement of these rights and obligations, etc.

4. Skyworld International does not represent event organisers, event performers or any other person responsible for the organisation, content and related information or advertising of such events. The organiser of the event is responsible for these matters, whose details can be found on the “Dinner in the Sky ®” online order form and whose contact details are on the admission ticket. Any requests concerning the organisation of events should be addressed directly to the organiser of the event in question.

5. The buyer will receive the ticket(s) from the Online Ordering System when paying for the ticket after confirming the order. You can print the tickets yourself.

6. Keep your ticket in a safe and secure place. Direct sunlight and heat can damage the flag.

7. Skyworld International is not obliged to refund or reimburse tickets in the event of cancellation, postponement or change of venue of the corresponding event. All cancellations or refunds are made by the organiser of the event, unless otherwise stated.

8. Any use of the “Dinner in the Sky®” online ordering site, its content and the information contained therein for any illegal activity, sale or resale of tickets, advertising, business or other profitable purpose, including ticket brokerage, is prohibited without the prior written consent of Skyworld International. Skyworld International is entitled to claim a penalty of up to EUR 100,000 for breach of contract from any buyer who has breached the above condition.

9. In the event of any breach of the terms and conditions of this Agreement by any person using the Online Ordering System, Skyworld International has the right to unilaterally terminate the access rights to the Online Shop and/or any ticket purchase transaction of the person who has committed the breach.

10. In any transaction in the online ordering system, the buyer declares that:

1) is at least 18 years old and has full direct and indirect legal rights to use the online ordering system;

2) is a legal person whose representative has all and any rights to use the online ordering system on behalf of the legal person and is responsible for all the obligations of the legal person;

3) the person responsible fulfils all the conditions for using the online ordering system.

11. Neither Skyworld International nor the organiser is obliged to check whether the person presenting the ticket is the person who purchased the ticket and neither party is liable for any damages resulting from the foregoing. If the buyer presents an admission ticket printed by the buyer when entering the event, the buyer is deemed to have arrived at the event.

12. Skyworld International reserves the right to change the terms and conditions of the online ordering system by prior notice/communication on the website www.dinnerinthesky.ee. The corresponding changes will enter into force once they are published on the website of the online shop.

13. Any requirements concerning the organisation, content, quality, advertising, etc. of the website must be submitted to the organiser of the event.

14. Any dispute concerning the website of the online ordering system shall be settled by the Harjumaa County Court in accordance with these Terms and Conditions and the law of the Republic of Estonia.

15. Skyworld International cannot view the bank card details of buyers’ purchases. To complete the payment transaction, the buyer is directed to the secure online environment of the Banks Card Centre. When paying, the card owner enters the card details into the Card Centre server files and all the purchase transaction details also go to the Card Centre server. Skyworld International is not responsible for the legality or illegality of the card data. To prevent misuse, Skyworld International may monitor the IP addresses of its customers to check for possible multiple card usage from the same IP address or under different recipient names. Skyworld International informs the bank of its suspicions of fraud.

16. In case of suspicion of fraudulent card payment, the Bank has the right to suspend the payment process pending investigation or to void the entire payment transaction. When the bank informs Skyworld International of an investigation into a payment transaction, Skyworld International may not release the transaction item (ticket) until the investigation is closed.

17. The MasterCard security code and the Visa system verification code are used when requesting card details.

18. The Terms and Conditions shall enter into force upon acceptance by the Buyer and shall remain in force for the duration of the legal relationship between the Buyer and Skyworld International; the corresponding terms and conditions shall govern this entire relationship. The buyer can cancel the transaction within 14 days of the purchase, but at least one week before the event.

19. The buyer accepts the purchase upon receipt of a notification letter from Skyworld LInternational to the e-mail address provided.

20. In the event of withdrawal from the contract, Skyworld International is obliged to refund the price of the ticket to the buyer, minus the service price and brokerage fee. If the buyer withdraws from the contract, Skyworld International is entitled to deduct from the amount to be refunded the brokerage fee, the amount of which is indicated on the ticket.

21. If the payment was made by debit card, the transaction can only be cancelled by sending a request to the bank containing the details of the transaction. The request must also state the reasons for the cancellation. No other means can be used to obtain a refund. The card issuer will be informed in writing of the cancellation of the transaction only on condition that the goods have been returned and the transaction has been cancelled by written request of the buyer.

22. When refunding the ticket price, any legal fees, shipping costs and additional expenses will be deducted from the refund amount.

23. The event may be disrupted by wind speeds above 15 m/sec and thunderstorms. If a withdrawal is not possible for the above reasons, food will be served in the lounge and all visitors will be gifted a Dinner in the Sky gift voucher of equal value in exchange for the withdrawal.

24. In the event of a withdrawal having to be interrupted due to weather conditions, visitors who have participated in the withdrawal for less than half of the agreed time will be reimbursed with a gift voucher worth 50% of the price of the interrupted withdrawal.

25. For safety reasons, all participants in Dinner in the Sky must be at least 140 cm tall.

26. Dinner in the Sky staff will help people with reduced mobility to participate safely if necessary.

27. For vegetarians, special meals are prepared if necessary. Please indicate this when making your reservation in the More information section

28. Children under 18 years of age may only participate if accompanied by an adult.
